Welcome to use the Daily Japanese Listening software and services provided by Hangzhou Youmiya Technology Co., Ltd. (hereinafter referred to as “Youmiya” or “Youmiya Company”)! Recently, Youmiya Company has updated and optimized the “Daily Japanese Listening Premium Membership Service Agreement”. Please read the optimized version carefully to ensure that you can better use our services.

1. Preamble

To use the “Daily Japanese Listening” software and services (hereinafter referred to as “the Platform” or “Daily Japanese Listening”), you should read and comply with the “Daily Japanese Listening Premium Membership Service Agreement” (hereinafter referred to as “this Agreement”). Please be sure to read carefully and fully understand the contents of each clause.

This Agreement is an agreement between the user (hereinafter referred to as “User” or “You”) and the Platform. The Platform will provide you with services in accordance with the content agreed in this Agreement. Unless you have read and accepted all the terms of this Agreement, you have no right to download, install or use the Platform and related services. Your downloading, installation, use, acquisition of Daily Japanese Listening account, login, purchase/acquisition of membership and other behaviors are deemed to have read and agreed to be bound by this Agreement.

If you are a minor, please read and judge whether to agree to this Agreement under the supervision of your legal guardian, and pay special attention to the minor clauses. A minor’s exercise and performance of rights and obligations under this Agreement is deemed to have obtained the approval of the guardian.

2. Service Description

For all membership services, in principle, no refunds will be given once payment has been deducted. If you encounter other issues, please contact customer service. We are committed to providing users with high-quality Japanese learning experiences and exclusive membership services.

Specific membership benefits may be adjusted and optimized according to product development needs. Adjusted benefits will be updated on the membership page in a timely manner. Please refer to the actual page display.

3. Paid Purchase Services

3.1 Purchase Methods

You can activate paid membership services through Daily Japanese Listening’s designated methods including but not limited to Apple App Store and other existing or future designated methods, after paying a certain fee as agreed. Membership service prices may vary depending on the version and channel of the software you use, and shall be subject to the amount displayed when activating the service.

3.2 Service Duration

3.2.1 Monthly Subscription

Valid for 30 days, calculated from the time of service activation.

3.2.2 Annual Subscription

Valid for 365 days, calculated from the time of service activation.

Each membership recharge purchase (1 month, 12 months or other periods) will correspondingly extend the validity period of the subscription membership. You need to recharge before the service expires to ensure normal enjoyment of privileges. After the service expires, subscription privilege services will be temporarily locked.

3.3 Payment Restrictions

You acknowledge and agree that paid membership services are network goods and virtual goods, adopting a pay-first-serve-later approach. Once paid membership services are activated, they cannot be transferred or refunded (except in cases where the paid membership service has major defects that make it completely unusable for you, or other circumstances stipulated in this Agreement or required by laws and regulations). If you encounter other issues, please contact customer service.

3.4 Prohibited Activities

You shall not activate/receive this service for yourself or others through any of the following methods: - For profit, business or other non-personal use purposes - Through any robot software, spider software, crawler software, screen brushing software or any other programs, scripts, software, etc. - Through any improper means or methods that violate the principle of good faith (such as exploiting rule loopholes, system vulnerabilities, illegal industries, speculation, etc.) - Through technical means to modify information such as membership service duration, consumption amount, transaction status, etc. - Through methods not designated by Daily Japanese Listening - Through methods that infringe upon the legitimate rights and interests of Daily Japanese Listening or others - Through other methods that violate relevant laws, administrative regulations, national policies, etc.

If you violate the above provisions, Daily Japanese Listening has the right to modify, limit, suspend or terminate all or part of your membership services according to your actual situation, without any compensation or refund of fees. When necessary, Daily Japanese Listening has the right to claim compensation.

4. Auto-Subscription Services

4.1 Auto-Renewal Mechanism

For subscription services purchased through third-party platforms (such as Apple App Store, etc.), they will automatically renew when the service expires. If renewal still fails after expiration, subscription privilege services will be temporarily locked until your next successful renewal.

4.2 Subscription Cancellation

Auto-renewal can be cancelled at any time, but no refunds will be provided for payments already deducted. You can cancel auto-subscription through the following methods:

4.2.1 Apple Device Users

Open Apple device “Settings” → Click “Apple ID” → Enter “Account Settings” → Click “Subscriptions”, select Daily Japanese Listening, and cancel subscription. To cancel subscription, please turn off auto-renewal at least 24 hours before billing.

4.3 Price Changes

During each auto-renewal, under normal circumstances, the price will remain at the current transaction price. If there are price changes, you will receive email notifications from the corresponding app store. If you do not agree to the change, you can cancel the subscription at any time.

4.4 Third-Party Platform Restrictions

Due to restrictions of third-party platforms (Apple, etc.), actual payment prices are subject to the actual display on the corresponding platform payment. Daily Japanese Listening cannot cancel auto-renewal services activated through third-party platforms; users need to manage them on the corresponding platforms themselves.

5. Payment Methods and Billing

5.1 Supported Payment Methods

We process all paid subscriptions through the App Store, supporting the following payment methods: - Credit/Debit cards linked to Apple ID - Apple Pay - App Store gift card balance

Subscription prices will vary according to different regions’ currencies and tax policies. The specific price is subject to the actual price you see in the app. Prices include applicable regional taxes.

6. Refund Policy

6.1 Refund Principle

For all membership services, in principle, no refunds will be given once payment has been deducted. However, you may apply for a refund from Apple under the following conditions.

  2. Tap your profile picture in the top right, go to Account
  3. Select Purchase History, find Daily Japanese Listening related orders
  4. Tap Report a Problem
  5. Choose Request a Refund, fill in the reason and submit

  2. Sign in with your Apple ID
  3. Find Daily Japanese Listening related purchase records
  4. Click Report a Problem, select refund reason and submit

7. User Account Usage Standards

7.1 Account Information

When registering for Daily Japanese Listening membership services, please fill in true and valid information. After becoming a Daily Japanese Listening member, you will enjoy various member-exclusive privileges.

7.2 Account Usage Restrictions

You shall not experience paid privileges by selling, transferring, stealing, or renting other user accounts, nor enjoy paid privileges by selling, transferring, stealing, lending, or renting other user accounts.

7.3 Compliant Usage

During your use of Daily Japanese Listening membership services, you should comply with laws, regulations and other normative documents, including but not limited to the “Law of the People’s Republic of China on Guarding State Secrets”, “Regulations of the People’s Republic of China on the Security Protection of Computer Information Systems”, “Cybersecurity Law of the People’s Republic of China”, “Regulations on the Protection of the Right of Communication through Information Networks”, etc.; you should abide by public order, respect social morality, not endanger network security, not use the network to engage in activities that endanger national security, honor and interests, incite subversion of state power, overthrow the socialist system, incite national division, undermine national unity, promote terrorism, extremism, promote ethnic hatred, ethnic discrimination, spread violence, obscene pornographic information, fabricate and spread false information to disrupt economic and social order, and infringe upon others’ reputation, privacy, intellectual property rights and other legitimate rights and interests.

Under any circumstances, once Daily Japanese Listening reasonably believes that you have engaged in the above behaviors, it may terminate the provision of membership services to you without prior notice.

7.4 Breach Handling

If you violate this Agreement or Daily Japanese Listening service terms, Daily Japanese Listening has the right to take one or more of the following measures: - Take technical measures to delete, block or disconnect relevant information - Modify, limit, suspend or terminate all or part of membership services - Collect liquidated damages and offset any fees, points or benefits you have paid but not used against liquidated damages; if liquidated damages are insufficient to compensate for losses, further require you to compensate for losses

8. Minor Protection

8.1 Special Reminder

Youmiya Company attaches great importance to the protection of minors. If you are a minor, you should read this Agreement under the supervision and guidance of your guardian, and use Daily Japanese Listening services only after obtaining the consent of your guardian.

8.2 Guardian Responsibility

Guardians should guide their children on safety issues that should be noted when surfing the Internet, and take precautions. If a guardian agrees to a minor’s use of Daily Japanese Listening membership services, they must apply for consumption in the guardian’s name and provide correct guidance and supervision for the minor’s use of Daily Japanese Listening membership services. A minor’s use of Daily Japanese Listening membership services, as well as the exercise and performance of rights and obligations under this Agreement, is deemed to have obtained the approval of the guardian.

8.3 Consumption Restrictions

To protect the rights and interests of minors, we recommend guardians: - Properly safeguard payment passwords and devices - Monitor minors’ payment behavior - Set reasonable consumption limits - Regularly check subscription status

9. Disclaimer

9.1 Service Content Adjustments

Youmiya Company has the right to independently decide the specific content of membership subscription services based on policy or regulatory changes, product plans and operational conditions, and has the right to add or remove content or suspend or terminate the provision of part of membership subscription services based on content copyright conditions. The aforementioned decisions will be announced after taking effect, and you agree that Youmiya Company is exempt from liability for this.

9.2 Technical Failures

We are not responsible for service interruptions or delays caused by the following situations: - Force majeure (such as natural disasters, government actions, etc.) - Apple App Store system maintenance or failures - Network transmission problems - User device or software issues

9.3 Third-Party Services

Our services may involve content or services provided by third parties. We are not responsible for the quality, accuracy, etc. of third-party content.

10. Agreement Modification

Youmiya Company has the right to modify this Agreement based on changes in national laws and regulations and factors such as maintaining operational order and protecting users. Once the modified agreement is published, it takes effect and replaces the original agreement. You can view the latest version of the agreement within the Daily Japanese Listening application or on the official website. If you do not agree to the modified agreement, you have the right and should stop using Daily Japanese Listening services. If you continue to use Daily Japanese Listening services, you are deemed to agree to the modified agreement.

We will notify you of important agreement changes through the following methods: - In-app popup notifications - Email notifications (if you provided an email address) - Official website announcements

11. Dispute Resolution

11.1 Applicable Law

The conclusion, execution, interpretation of this Agreement and the resolution of disputes shall be governed by the laws of the People’s Republic of China.

11.2 Dispute Handling

If any dispute arises between the parties regarding the content or execution of this Agreement, the parties should try to resolve it through friendly consultation; if consultation fails, either party may file a lawsuit with the people’s court where Youmiya Company is located.
